TERMS AND CONDITIONS OF TRADING OF

 W.A. TRUELOVE & SON LIMITED

(THE COMPANY)

 

 

1.            ACCEPTANCE OF ESTIMATE:

(a) By signing the Estimate the signatory ("the Client') accepts personal liability for paying the Company's charges in full, regardless of any entitlement the Client may have to payment from or re-imbursement by a third party

(e.g. by the DSS or the deceased's estate).

b) The Company will confirm the details of the chosen funeral in writing, and the Client agrees to inform the Company immediately of any errors or omissions.

    

 2.             FINAL CHARGES:

The Client acknowledges and accepts that the Company's charges may vary from the Estimate overleaf:

(a) if the actual cost of the listed disbursements is higher than estimated; or,

(b) if the Client's instructions change or if the circumstances change, involving additional charges (e.g. out of hour charges; additional bearers required; extra large coffin required).

(c) if the time or mileage allowances, as shown on our price list, are exceeded, additional charges will be made.

 

3.             PAYMENT TERMS:

(a) Where the Client has selected a "Contract' funeral, all charges and disbursements are payable in full at least 48 hours before the funeral takes place, (time being the essence). If payment is not so made then the funeral will be charged as a "Basic' funeral.

(b) All disbursements are payable in full at least 48 hours before the funeral takes place. Failure to do so may result in the funeral arrangements being delayed or even cancelled.

(c) Subject to Clauses 3(a) and 3(b) above, the Client agrees to pay the Company's charges in full within 28 days of the date of the Company's invoice.

(d) The Company shall be entitled to charge interest on overdue invoices at the rate of 6% above the base rate, from time to time, of Barclays Bank PLC until payment is received in fuIl. Further, the Company shall be entitled to charge the Client for all third party costs and expenses (including, without limitations, the cost and expenses of any debt collection agency and/ or solicitors instructed by the Company, as well as any Court fees, filing fees and associated costs) incurred in the collection of overdue invoice payments.

(e) When payment is made by Credit Card, a 2% surcharge is added to the cost of disbursements, (not to the Company's charges), to cover the Credit Card Company's charges on these items.

 

4.             THIRD PARTY ARRANGEMENTS:

While the company will make arrangements with third parties, (e.g. clergy, cemetery / crematorium, church, doctor), and will include their charges as disbursements on the invoice, the Client acknowledges the Company is not responsible for the acts or omissions of such third parties. In making such arrangements the Company is acting as the Client's agent.

 

5.             ALTERATIONS

(a) All dates and times for the funeral are subject to final confirmation by the Company.

(b) The Company reserves the right to make changes to funeral arrangements due to reasons beyond its control. Where practicable, such changes will be notified to the Client in advance, but, unless otherwise agreed in writing, the Company's charges remain payable in full.

(c) The Client must give reasonable notice to the Company of any requested changes to funeral arrangements, and such requests are subject to agreement by the Company.

 

6.             COMPLAINTS PROCEDURE:

The Company is a member of the National Association of Funeral Directors and the Client accepts that the complaints and conciliation procedures of such Association will apply. The Client's statutory rights are not affected.

 

7.             HEADINGS:

The headings are convenience only and shall not be used to interpret these Terms and Conditions of Trading.
